WHAT DOES THE REGULATION PROVIDE?
As of September 1, 2025, Regulation (EU) 2023/1545 will enter into force, prohibiting the use of TPO (Trimethylbenzoyl-diphenylphosphine oxide) in cosmetic products, including gels, semi-permanent polishes, and other nail products, throughout the European Union.
TPO has been included in Annex II of Regulation (EC) 1223/2009 (substances prohibited in cosmetic products) as it is classified as toxic to human health.

Always check the label (INCI): if you find Trimethylbenzoyl-diphenylphosphine Oxide, the product will no longer be usable from September 1st.

SANCTIONS AND LIABILITY
Anyone who continues to use or possess products containing TPO after August 31, 2025, may face administrative penalties of up to €60,000, according to Legislative Decree 204/2015.
In the event of repeat offenses or harm to clients (such as allergic reactions), authorities may order:
1) Temporary closure of the business
2) Civil and criminal liability of the beautician or owner
3) Seizure of non-compliant products
BEWARE OF FOREIGN OR LOW-COST BRANDS
Many products sold online or through non-professional channels come from countries where TPO is not prohibited (China, Russia, Ukraine, United Kingdom, USA).
These products must be disposed of by August 31, 2025.
In the event of an inspection or a client reaction, you could be held legally responsible for ingredients you don't truly know.
